Information on Housing and Benefits Cases During the Public Health Emergency

  • Housing court is currently open but is limiting “in person” operations to emergency cases and those in which someone is not able to access the court through phone or remote operations. Emergencies are post evictions, illegal lockout cases and emergency repair (emergency “HP”) cases. Nonemergency cases are being handled through remote conferences wherever possible.
  • There will be no evictions legally allowed until October 1, 2020. However, cases will be treated differently depending on whether they started before or after March 17, 2020, and whether they are “post-judgment.”
    • If your case started before March 17, 2020 you are still protected by the statewide ban on evictions until October 1, 2020.
      • If your case is “post-judgment” your landlord must make a motion before being permitted to evict you
      • That motion will give you a chance to get a lawyer if you do not already have one and to ask to prevent your eviction if you have been financially impacted during the pandemic
      • Any tenant who is determined to be subject to eviction must also receive a 14-day marshal’s notice before their eviction
      • If your case started before March 17, 2020 but it is not post-judgment, the Court will contact you by mail (or phone or email if available) when it is ready to consider your case
    • If your case started after March 17, 2020 the Court will contact you by mail (or phone or email if available) when it is ready to consider your case

  • Request for a FREE LAWYER by calling 718-557-1379 or by visiting nycourts.gov/evictions/nyc/
  • AND ask a judge to prevent their eviction if they have been financially impacted during the pandemic
